Chase Harper to gay Poway HS students: "God hates you!"
Ninth Circuit to Chase Harper: "Suck it."

This isn't over, yet. This particular appeal was just over the trial judge refusing to issue a TRO forbidding the district from enforcing its dress code. But the Ninth Circuit does not often uphold restrictions on speech, so when it does, you should take that as a warning. In a year's time, I fully expect "Suck it again" to be handed down from San Francisco. By then, Chase will be a college freshman.

I have to agree with Judge Kozinski. Once the school injected itself into the issue they should be prepared to entertain all viewpoints.

Absolutely. Even the Nazis[1] get to march in Skokie. But there's a line between saying "I think [foo] is shameful" and "Be ashamed, [foo] person". One's an expression, one's an attack. I'm not clear where (or if?) this is being looked at in court, but the particular element of the dress code he was busted for was the part that forbid home-made shirts. He wasn't busted for the speech itself, but for expressing it with magic marker on masking tape stuck to his shirt, according to what I was told at the time it happened. He could've stuck "Don't Worry Be Happy" on his shirt that way and still been in violation.

I think the school's been pretty fair about things. The day-of-silence kids don't get disciplined for it, and neither do the see-you-at-the-pole kids. As long as neither group goes out of their way to antagonize the other, they're left alone.
